Welcome to Cool Mountain Theatre. By using our website, purchasing tickets, making donations, participating in our productions or programs, signing up for our communications, or otherwise interacting with us, you agree to these Terms and Conditions. Please read them carefully.

About Cool Mountain Theatre

Cool Mountain Theatre is a 501(c)(3) nonprofit performing arts organization based in Georgetown, Indiana, operating out of the NoCo Arts Center in Jeffersonville, Indiana.

Website Use

The content on coolmountain.company is provided for informational and operational purposes. You may view, share, and reference our content for personal and noncommercial use. You may not reproduce, distribute, modify, or use our content for commercial purposes without our written permission, except as permitted by fair use under copyright law.

You agree to use our website in a manner consistent with all applicable laws and not to interfere with its operation, attempt to gain unauthorized access, or disrupt other users.

Ticket Purchases and Donations

Ticket purchases and donations made through Cool Mountain Theatre are subject to the terms presented at the time of purchase, including refund policies, performance dates, and seating policies. Donations are nonrefundable and may be tax-deductible to the extent allowed by law; consult your tax advisor for guidance.

Performance dates, times, casts, and program content are subject to change. We will make reasonable efforts to notify ticket holders of changes through the contact information provided at purchase.

SMS Text Messaging Program

Cool Mountain Theatre operates an Optional SMS text messaging program for operational communication with auditioners, cast, crew, volunteers, and staff.

By providing your phone number on an audition form, casting paperwork, crew sign-up form, volunteer registration form, or any other Cool Mountain Theatre form that includes SMS consent language, you agree to the following terms regarding our SMS messaging program:

Program Description: Cool Mountain Theatre uses SMS to send operational notifications to auditioners, cast, crew, volunteers, and staff regarding auditions, callbacks, rehearsals, performances, call times, scheduling changes, costume fittings, production meetings, and related logistics.

Consent: By providing your phone number and acknowledging consent on a Cool Mountain Theatre form, you expressly consent to receive recurring SMS text messages from Cool Mountain Theatre at the phone number provided. SMS consent is voluntary and not a condition of participation in any Cool Mountain Theatre production, activity, or service.

Message Frequency: Message frequency varies based on production schedule. During active rehearsal and performance periods, you may receive multiple messages per week. Between productions, frequency is typically lower.

Costs: Message and data rates may apply. Cool Mountain Theatre does not charge for SMS messages, but standard rates from your wireless carrier may apply. Contact your carrier for details about your plan.

Opt-Out: You may opt out at any time by replying STOP to any message from Cool Mountain Theatre. After replying STOP, you will receive one final confirmation message and no further messages from this program. Opting out will not affect your ability to participate in Cool Mountain Theatre productions or activities, though you may need to receive notifications through other channels.

Help: Reply HELP to any message to receive contact information for support.

Supported Carriers: This program is available on all major US carriers, including AT&T, T-Mobile, Verizon, and others. Carriers are not liable for delayed or undelivered messages.

Eligibility: You must be at least 18 years old to consent to receive SMS messages on your own behalf. Participants under 18 must have a parent or legal guardian provide consent.

Privacy: Your participation in our SMS program is subject to our Privacy Policy. We do not share, sell, rent, or transfer your phone number or SMS opt-in information to third parties for marketing or promotional purposes.

Email Communications

If you provide your email address, you may receive periodic email communications about Cool Mountain Theatre productions, events, and organizational news. You may unsubscribe at any time using the unsubscribe link in any email or by contacting us directly.

Production and Program Participation

Participation in Cool Mountain Theatre auditions, productions, and other programs is subject to additional terms communicated through audition materials, casting paperwork, volunteer agreements, and other documentation as applicable. By participating, you agree to abide by Cool Mountain Theatre’s policies regarding conduct, attendance, safety, and creative process.

Intellectual Property

All content created by Cool Mountain Theatre, including productions, marketing materials, and website content, is the property of Cool Mountain Theatre or used with permission from rights holders. Production materials licensed from third parties (such as scripts, scores, and recordings) are subject to the terms of those licenses.

Photo and Video Use

Cool Mountain Theatre may photograph or record productions, rehearsals, events, and activities for archival, promotional, and educational purposes. By participating in or attending Cool Mountain Theatre activities, you acknowledge that you may appear in such materials. Participants in productions sign separate releases for performance documentation. If you do not wish to appear in photos or videos, please notify us in writing.

Disclaimers

Cool Mountain Theatre provides its services, communications, productions, and website “as is” and makes no warranties, express or implied, regarding their accuracy, reliability, availability, or suitability for any particular purpose. We are not liable for any indirect, incidental, special, or consequential damages arising from your use of our services, communications, or website.

Limitation of Liability

To the fullest extent permitted by law, Cool Mountain Theatre’s total liability arising out of or related to these Terms or your use of our services shall not exceed the amount you paid to Cool Mountain Theatre in the twelve months preceding the claim, or one hundred dollars, whichever is greater.

Changes to These Terms

We may revise these Terms and Conditions from time to time. The “Last Updated” date at the top reflects the most recent revision. Continued use of our website, participation in our programs, or interaction with Cool Mountain Theatre after changes are posted constitutes acceptance of the updated terms.

Governing Law

These Terms are governed by the laws of the State of Indiana, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Floyd County, Indiana.
